Termination by mutual consent

Employment relationships can be terminated by mutual consent without observing a notice period by means of a termination agreement. I advise and represent employees and employers in the amicable termination of employment relationships.

The following points in particular can be regulated in the termination agreement:

  • Termination of the employment relationship by mutual consent and termination date
  • Wage payment obligations of the employer
  • If applicable, further compensation by the employer (e.g. bonus, etc.)
  • Payment of the thirteenth month’s salary
  • Compensation for holidays not taken (if no garden leave)
  • Employee’s duty to work
  • Employee’s leave of absence (holidays are considered taken during garden leave)
  • Outplacement of the employee
  • Employee’s duty of return
  • Employee’s duty of confidentiality
  • Non-competition (agreement or waiver)
