I advise and represent tenants in asserting an extension and landlords in defending against tenants’ requests for an extension.
Tenants can challenge a termination and combine the termination challenge with a request for an extension. If a tenant has not requested an extension at the same time as contesting the termination, the conciliation authority will consider the extension even without an explicit request. They can also acknowledge the validity of the termination and only file an extension request. If the tenancy has already been extended once and this extension is not final, a second extension may be requested before the expiry of the first extension period.
An extension of the tenancy of residential and commercial premises is only possible if the termination of the tenancy would mean hardship for the tenant. If the termination was extraordinary due to the tenant’s default in payment, an extension is not possible.
