Subletting requires the landlord’s consent, which may only be refused under certain conditions. In detailed commercial leases the conditions for subletting and refusal of consent are often already defined. However, the fulfilment of the conditions can be unclear and contentious.
The sublease must be agreed in a sublease agreement. For evidentiary reasons, a written sublease agreement is recommended. The landlord’s consent does not need to be in writing, but for evidentiary reasons it is recommended that this too is obtained in writing.
